Convey, Inc. (“Convey,” “we,” “us,” and “our”) operates a delivery experience management platform (the “Platform”) for supply chain and customer experience leaders (“Customers”) for pre-purchase delivery dates, intelligent outcome-based execution, advanced shopper communication, exception management, and transportation analysis.

SCOPE

This Privacy Policy applies to personal information processed by Convey in connection with its website (“Site”) and its Platform (collectively, the “Services.”)

For the avoidance of doubt, any personal information processed by our Customers via the Convey Platform will be governed by our Customer’s privacy policy. Convey only processes personal information in accordance with our Customer agreements and Customer instructions. If you have questions about how your personal information is processed via the Convey Platform, please refer to the relevant Customer’s privacy policy.‍

PERSONAL INFORMATION WE COLLECT

Information You Provide to Us

Account Creation. We will collect your name, email address, and phone number.

Communications with Us. We collect personal information from you such as email address or phone number when you use our products or Services, request information about our Services (including a demo), ask to download content, subscribe to our newsletter, or otherwise communicate with us.

Surveys. We may ask you to participate in surveys. If you participate, we may ask you to provide certain personal information.

Interactive Features. We may offer certain interactive features through which we and others who use our Services may collect the information you submit or make available through these interactive features. Any content you provide on the public sections of these features will be considered “public” and is not subject to this Privacy Policy. By using these interactive features, personal information provided by you may be viewed and used by third parties for their own purposes.

Customer Service. If you interact with Convey’s customer service, we may collect personal information you provide. Upon your explicit consent we may also record audio or video calls between you and our representatives for training, quality assurance or issue resolution purposes.

Trade Shows, Conferences, and Other Events. We may attend trade shows, conferences, and other events where we collect personal information. If you provide us with any information at one of these events, we will use it only for the purposes for which it was collected.

Business Opportunities. We may collect personal information to assess and pursue potential business opportunities.

Job Applications. If you submit personal information in reply to a job posting, we will process such information only to assess your qualifications for employment with Convey.

Automated Collection

Automatic Data Collection. We may collect information automatically when you use the Services, which information may include your Internet protocol (IP) address, user settings, MAC address, cookie identifiers, details about your browser, operating system or device, location information (including inferred location based off of  your IP address), Internet service provider, mobile carrier, actions that you take while using the Services, information about the links you click, and information about how you interact with the Services.  Information we collect may be associated with accounts and other devices.

Cookies, Pixel Tags/Web Beacons, and other Technologies. We and third parties that provide content, analytics, advertising or other functionality on the Services, may use cookies, pixel tags, and other technologies (“Collection Technologies”) to automatically collect information through the Services.

Information We Process via the Convey Platform

Tracking and Order Status. If you make a purchase from one of our Customers and are the recipient of a package, you may be provided a link to a Convey’s tracking page in order to check the status of an order. When Customers use our shipping and order tracking or alert Services, we receive name, order, and shipping information from a carrier or our Customer, which  information is governed by our Customer’s privacy policy, not ours.

Email Alerts. The Convey Platform also allows Customers to ensure that their consumers can obtain information about their orders via email. In this case, we will use email address and other information submitted to us to provide such email messages. You may opt out of receiving emails messages by unsubscribing from the email message you have received from us or by otherwise contacting us.

SMS Alerts. The Convey Platform also allows Customers to ensure that their consumers can obtain information about their orders via SMS. In this case, we will use phone number and other information submitted to us to provide such text messages. You may opt out of receiving text messages by replying “STOP” to a text message you have received from us or by otherwise contacting us.‍

HOW WE USE YOUR INFORMATION

We use your personal information for a variety of purposes, including:

To provide the Services, such as:

  • Fulfilling our contract with the organization on whose behalf you use the Services; and
  • Responding to questions, comments, and other requests, including technical support;

Administrative Purposes, such as:

  • Marketing, research and development and network and information security;
  • Measuring interest and use of our Services;
  • Improving the Services and developing new products and services;
  • Ensuring internal quality control;
  • Authenticating individual identities;
  • Conducting audits;
  • Communicating about your account, our Services and Privacy Policy changes;
  • Preventing prohibited or illegal activities;
  • Complying with legal obligations.

Marketing. We may use personal information to customize and provide you with content.

Consent. We may use personal information for other purposes that are disclosed to you at the time you provide personal information or with your consent.

Anonymized and Aggregated Information. We may use personal information and other data about you to create anonymized and/or aggregated information. Anonymized and/or aggregated information is not personal information, and we may use and disclose such information for legally permissible purposes.‍

DISCLOSURES TO THIRD PARTIES

We may share your personal information with the following types of third parties and the following events:

Customers. If you use our Services on behalf of our Customer (e.g., your employer), our Customer may access information associated with your use of the Services.

Service Providers. We may share your personal information with our third-party service providers in connection with : (i) the provision of the Services; (ii) the provision of information you have requested; (iii) marketing; (iv) payment and transaction processing; (v) customer service activities; and (vi) the provision of information technology and related services.

Business Partners. We may provide personal information to business partners to provide you with a product or service you have requested. We may also provide personal information to business partners with whom we jointly offer products or services.

Compelled Disclosures. We may disclose any information we store in association with you to external parties if we believe doing so is required or appropriate to: (i) comply with law enforcement and legal process, such as a court order or subpoena; (ii) protect your, our, or others’ rights; (iii) enforce our policies or contracts; (iv) collect amounts owed to us; or (v) assist with an investigation and prosecution of suspected or actual illegal activity.

Merger, Sale, or Other Asset Transfers. If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, receivership, purchase or sale of assets, or transition of service to another provider, then your information may be sold or transferred as part of such a transaction.

YOUR RIGHTS

General. You may have the right to opt out of uses of your personal information. Except as otherwise provided in this Privacy Policy, we do not sell your personal information.

Email Communications.If you receive an unwanted email from us, you may use the to opt out of receiving future emails or you can contact us .  You will continue to receive transaction-related emails regarding our Services and we may also send you certain non-promotional communications regarding us and our Services (e.g., communications regarding the Services or updates to this Privacy Policy), and you will not be able to opt out of those communications.

“Do Not Track”. Do Not Track (“DNT”) is a privacy preference that users can set in certain web browsers, but we do not respond to or honor DNT signals or similar mechanisms transmitted by web browsers.

In accordance with applicable law, you may have the right to: (i) request confirmation that we are processing your personal information; (ii) obtain access to or a copy of your personal information or ask us to send that information to another company; (iii) restrict or object to our uses of your personal information; (iv) seek correction or changes of your personal information; (v) withdraw your consent; provided that if you withdraw your consent, some features of the Service may not be available; and/or (vi) request erasure, anonymization, or blocking of personal information; (vii) be informed about third parties with which your personal information has been provided.

DATA RETENTION

We store personal information we receive as described in this Privacy Policy for as long as you use our Services or as necessary to fulfill the purpose(s) for which it was collected, and to comply with applicable laws.

SECURITY OF YOUR INFORMATION

We use commercially reasonable efforts to ensure that your information is processed securely and in accordance with this Privacy Policy, but we cannot warrant the security of any information you provide to us. To the extent permitted by applicable laws, we do not accept liability for unauthorized disclosure.

By using the Services, you agree that we may communicate with you regarding security, privacy, and administrative issues relating to your use of the Services.  If we learn of a security system’s breach, we may attempt to notify you by posting a notice on the Services, by postal mail, or by sending an email to you.

SUPPLEMENTAL PRIVACY NOTICE FOR CALIFORNIA RESIDENTS

This Supplemental Privacy Notice for California Residents applies to our processing of personal information that is subject to the California Consumer Privacy Act of 2018 (“CCPA”). The following information describes the categories of personal information Convey has collected about California residents and whether Convey disclosed that personal information for a business purpose (e.g., to a service provider) in the preceding 12 months:

Additional Rights for California Residents

“Sales” of Personal Information. For purposes of the CCPA, Convey does not “sell” personal information, and we do not have actual knowledge of any “sale” of personal information of minors under 16 years of age.

Non-Discrimination. California residents have the right not to be discriminated against for the exercise of their rights under the CCPA.

Authorized Agent. Only you, or your authorized agent, may make a verifiable consumer request related to your personal information. To designate an authorized agent, please contact us as provided below.

Verification. When you make a request under the CCPA, we will ask you to provide information that allows us to verify you are the person about whom we collected personal information or an authorized representative, which may include verifying your email address or other information you have provided to us.  If you are a California resident and would like to exercise any of your rights under the CCPA where Convey is acting as a “business”, please contact us as provided below.

LAWFUL BASES FOR PROCESSING

For purposes of the EU General Data Protection Regulation, Convey’s processing of your personal information is supported by the following lawful bases:

Performance of a Contract:Convey may process your personal information to perform our contract with our Customer.

Legitimate Interest:Convey may process personal information to further our legitimate interests but only where our interests are not overridden by your interests or rights.

Consent: Convey may rely on your consent to process your personal information.

Compliance with Legal Obligations:Convey may process personal information to comply with our legal obligations.

SUPERVISORY AUTHORITY

If you reside in the European Economic Area or the United Kingdom you may file a complaint with a supervisory authority if you believe our processing of your personal information violates applicable law.

THIRD-PARTY WEBSITES/APPLICATIONS

The Services may contain links to other websites/applications and other websites/applications may reference or link to our Services. Such third-party services are not controlled by us and we do not endorse, screen or approve, and are not responsible for, the privacy practices or content of such other websites or applications.

CHILDREN’S INFORMATION

The Services are not directed to children under the age of 13 (or other age as required by local law), and we do not knowingly collect personal information from children. If you know that your child has provided us with personal information without your consent, you may contact us as provided below. If we learn that we have collected a child’s personal information in violation of applicable law, we will take steps to delete such information and terminate the child’s account.

CHANGES TO OUR PRIVACY POLICY

We may revise this Privacy Policy at any time. If we make any material changes to this Privacy Policy, we will notify you as required by applicable law. You acknowledge and agree that you will be deemed to have accepted the updated Privacy Policy if you continue to use the Services after the new Privacy Policy takes effect.
